A 38-year-old Elk City man has been released from jail after being charged with petit larceny and felony obstruction of an officer after allegedly walking out on a tab at an area restaurant.

The investigation began on October 4 after the Elk City Police Department received a call about a man leaving a restaurant without paying his bill.

The waitress reportedly spotted David Scott Lakes across the street at an area convenience store.

Upon arrival, the ECPD officer approached Lakes. Lakes was reportedly smoking a cigar. Lakes reportedly denied being at the restaurant and refused to give his name and birth date. The officer states that this was “hindering and delaying our investigation into if he was the subject who left without paying.”

A restaurant employee was reportedly present and identifi ed Lakes.

Security footage allegedly showed Lakes enter and leave the restaurant.

Lakes was transported to the Elk City Municipal Jail, but he reportedly refused to answer booking questions.

He was placed in the drunk tank.
