A 53-year-old Elk City man has been released from jail after being charged with assault.

The investigation began on August 16 when the Elk City Police Department was called to a reported alleged fight near 20th Street and Main Street.

Upon arrival, the officer found a witness who said the fighting couple had walked west along 20th to the Hutch’s Convenience Store.

The officer reportedly found the pair with the woman reportedly crying in the bathroom and blood coming out of her lip.

The woman allegedly said Kevin Smith had become upset because he reportedly couldn’t find his wallet and “attacked her, threw her to the ground onto her back, straddled her torso, and repeatedly hit her head against the ground.”

The woman alleged Smith hit her head a “few” times.

The woman did state that Smith did not punch or kick her.

A second officer spoke to a witness at the original location, who reportedly confi rmed that they had seen the alleged victim “on her back” after reportedly being thrown down by Smith.

Smith allegedly admitted to two ECPD officers that he threw her to the ground in anger at the belief that she had taken his wallet.
