A 63-year-old Elk City man is being held on a $150,000 bond at the Beckham County Detention Center after being charged with first-degree rape by instrumentation.

The investigation against David Leon Mc-Guire reportedly began at approximately 5:20 pm on November 28 in Elk City when an Elk City Police Department detective was informed by an Oklahoma Department of Human Services investigator of an alleged sexual assault upon a 12-year-old.

The man was reportedly identified as Mc-Guire, her reported foster care father.

The alleged victim and other minors in the home were reportedly interviewed.

Several details from the probable cause affidavit have been omitted due to the case’s sensitive nature.

However, McGuire reportedly denied any allegations of sexual assault.

During questioning, though, the ECPD detective stated that McGuire allegedly admitted to touching the child inappropriately. He also reportedly penned a letter to the child asking for forgiveness.
