Elk City man jailed after alleged loitering makes staff uncomfortable

A 32-year-old Elk City man was jailed for second and subsequent driving under the infl uence after a store’s staff reportedly became uneasy about the group.

A 32-year-old Elk City man was jailed for second and subsequent driving under the infl uence after a store’s staff reportedly became uneasy about the group.

The Elk City Police were dispatched at approximately 2:46 pm on December 2 after receiving a call to a local store.

The call was in reference to a gray Chevrolet pickup with construction equipment in the bed.

The truck was no longer at the scene, but staff was able to show a photograph and said one of the men had attempted to follow a female staffer into the bathroom.

While at the store, the reporting officer said he saw a truck matching the description drive by.

The man driving had been at the store on more than one occasion and had reportedly made them uncomfortable on multiple occasions.

The officer was able to initiate a traffic stop and requested a second officer arrive.

At that point, he made contact with the driver, Jose Funez-Rivera.

The vehicle also had two passengers. The officer reportedly observed an open Corona box with multiple empty beer bottles.

At approximately 5 pm, Funez-Rivera allegedly admitted to drinking five beers.

Funez-Rivera reportedly refused a field sobriety test, but the officer stated that he observed signs of intoxication.

Funez-Rivera’s truck was taken to a local hotel where the group was staying rather than being impounded.

The suspect did agree to the state’s breath test. He reportedly tested at .22, more than twice the legal limit.

His history shows a previous conviction of DUI in Texas in 2021.

The report does not indicate which man allegedly followed a female staffer into the bathroom.
